1. Copyright Policy

Audicible respects the intellectual property rights of others and expects our users to do the same. We have zero tolerance for copyright infringement and will respond promptly to valid DMCA takedown notices.

This policy outlines our procedures for addressing claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws.

2. Audicible's Role

Important Notice

Audicible is a platform that provides access to radio streams operated by third-party broadcasters. We do not host, store, or control the content broadcast by these stations.

While we facilitate access to radio streams, the content is provided directly by independent radio stations and broadcasters. We work with copyright holders to address legitimate concerns about infringing content.

3. DMCA Takedown Procedure

If you believe that content accessible through Audicible infringes your copyright, you may submit a DMCA takedown notice. Your notice must include the following information:

  • Your physical or electronic signature
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the infringing material and its location on our service
  • Your contact information (address, phone number, email)
  • A statement of good faith belief that the use is not authorized
  • A statement that the information is accurate and you are authorized to act
  • A statement made under penalty of perjury

4. How to Submit a DMCA Notice

5. Counter-Notification Process

If you believe your content was removed in error, you may submit a counter-notification containing:

  • Your physical or electronic signature
  • Identification of the removed content and its former location
  • A statement under penalty of perjury that the removal was a mistake
  • Your contact information
  • Consent to jurisdiction of federal court in your district

Upon receiving a valid counter-notification, we will forward it to the original complainant. If they do not file a court action within 10 business days, we may restore the content.

6. Repeat Infringer Policy

Enforcement Policy

We will terminate accounts of users who are determined to be repeat infringers.

Audicible maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We may also remove access to radio stations that repeatedly broadcast infringing content.

7. Safe Harbor Compliance

Audicible qualifies for safe harbor protection under the DMCA as a service provider. We:

  • Do not have actual knowledge of infringing activity
  • Do not receive financial benefit directly attributable to infringing activity
  • Respond expeditiously to remove infringing content upon notification
  • Have designated an agent to receive infringement notifications
  • Maintain a policy for terminating repeat infringers

8. False Claims and Misrepresentation

Legal Warning

Submitting false DMCA claims may result in legal liability for damages, including attorney fees.

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that content is infringing may be liable for damages. Please ensure your claims are accurate and made in good faith.

9. International Copyright Laws

While this policy primarily addresses U.S. copyright law and the DMCA, we also respect international copyright laws and treaties. Copyright holders from other countries may submit takedown requests, which we will evaluate under applicable international agreements and local laws.

10. Radio Station Compliance

Radio stations accessible through Audicible are responsible for:

  • Obtaining proper licenses for the content they broadcast
  • Complying with their local copyright laws and regulations
  • Responding to copyright claims related to their content
  • Maintaining appropriate broadcasting licenses and permissions

11. Limitation of Liability

Audicible's liability for copyright infringement is limited to the extent provided by the DMCA and other applicable laws. We are not liable for content provided by third-party radio stations, and our role is limited to providing access to publicly available radio streams.
